Compensation and registration of residential areas destroyed as a result of emergencies simplified

Systematic measures are being implemented in our country to simplify procedures for the registration of rights to real estate, ensure citizen satisfaction, and improve the legislative framework. In this regard, the implementation of the Law adopted on July 14, 2025, ‘On Amendments to the Land, Civil, Housing, Urban Planning, and Construction Codes, the Laws of the Republic of Azerbaijan on the Management of Municipal Lands, on the Preparation and Coordination of Documents for the Allocation of Municipal Lands, and on the State Register of Real Estate’ is of particular importance.

According to the amendments, if it is deemed inappropriate to construct new residential premises on land plots where residential areas were destroyed due to an emergency, replacement land plots will be allocated from the state reserve fund. If this is not possible, land plots owned by municipalities of equivalent value will be allocated for use. In such cases, the land plots will be provided by the municipality without holding an auction and without requiring opinions from the relevant state authorities. The law stipulates that in the following cases, construction works are carried out not on the land plots where property was destroyed due to an emergency, but on the new land plots:

  •           if the land plot is classified as a high-risk area for construction due to a natural disaster;
  •           if construction is not permitted on the land plot according to its designated use;
  •           if the land plot is located within the protection zones of utility lines.

These reasons will be determined based on the investigation conducted by the Ministry of Emergency Situations, and the citizen will be informed of the results.

The law ensures the protection and efficient use of land by the state while taking into account the interests and rights of citizens. Specifically, if a citizen does not agree to the construction of a residential area on a new land plot, their interests are taken into account, and the value of the previous land plot is paid to the owner, transferring ownership to the state.

The law also regulates issues related to the registration of rights over new residential properties constructed with state funds as replacements for property destroyed due to emergencies.
